Terms of Service

1. Who we are

TapeCharts ("the Service") is operated by FinTimers Inc., a Delaware corporation (United States) ("FinTimers", "we", "us"). Contact: support@tapecharts.com. By creating an account or using the Service you agree to these Terms.

2. What the Service is — and is not

TapeCharts is analytics, visualization and workflow software for traders: real-time market-depth and order-flow telemetry, charting, a trading journal, post-trade analytics and educational content. TapeCharts is not a broker, dealer, exchange, custodian, investment adviser or portfolio manager. We never hold your funds or assets, and nothing in the Service constitutes investment, financial, legal or tax advice or a recommendation to buy or sell any asset. 3. Eligibility and jurisdictions

You must meet the age of majority applicable to your residence jurisdiction as enforced at registration (21+ in the United States, the United Arab Emirates, Qatar and Saudi Arabia; 19+ in South Korea; 18+ elsewhere). The Service is not available to residents of comprehensively sanctioned jurisdictions. You are responsible for ensuring that your use of the Service and of any connected exchange is lawful where you live.

4. Your exchange accounts and API keys

Optional execution features connect to your own accounts at supported third-party exchanges using API keys that you create and own. Keys are stored and used server-side only and are never exposed to your browser. Withdrawal-enabled keys are refused. Every live order requires your explicit per-order confirmation. All trading performed through your keys is your sole decision and responsibility; your relationship with the exchange is governed by that exchange's own terms.

5. Acceptable use

You agree not to: share, resell or scrape the Service or its market-data streams; redistribute data feeds outside the Service; probe, disrupt or overload our infrastructure; attempt to access other users' data; use the Service to violate law, sanctions or exchange terms; or misrepresent outputs of the Service as advice to third parties. We may rate-limit, suspend or terminate accounts that breach these rules.

6. Subscriptions and billing

During private preview, access is provisioned individually and free unless agreed otherwise. When paid plans launch, prices, billing cycles and refund terms will be shown at checkout and will supplement these Terms. Taxes may apply based on your location.

7. Intellectual property

The Service, including its rendering engines, analytics, design and content, is owned by FinTimers Inc. and protected by law. We grant you a personal, non-exclusive, non-transferable licence to use the Service. Your journal entries and screenshots remain yours; you grant us the limited licence needed to store and display them back to you.

8. Availability

The Service depends on third-party exchanges, data feeds and networks. We aim for high availability but the Service is provided "as is" and "as available", without uptime guarantees. Market data may be delayed, incomplete or unavailable at any time.

9. Disclaimer of warranties and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for trading losses, loss of profits, loss of data, or indirect, incidental, special or consequential damages arising from use of the Service. Our total aggregate liability for any claim is limited to the amounts you paid us for the Service in the twelve months preceding the claim, or USD 100 if you paid nothing. Nothing here excludes liability that cannot be excluded by law.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, legal necessity, or discontinuation of the Service, with reasonable notice where practicable.

11. Changes

We may update these Terms; material changes will be announced in the Service or by e-mail. Continued use after the effective date of a change constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction, unless mandatory consumer law in your country provides otherwise.
